JUDGEMENT ON VERDICT GUILTY

 

            Now on this 30th day of April, A.D. 1918, the defendants, in their own proper persons, and with their counsel being present in open Court, comes John W. Preston, Esq., United States Attorney, and moves the Court that judgment be pronounced in this cause; whereupon the defendants were duly informed by the Court of the nature of the Indictment filed on the 7th day of July, A.D. 1917, charging them with the crime of conspiring to violate Section 13 of the Criminal Code of the United States; of their arraignment and pleas of Not Guilty; of their trial and the verdict of the Jury on the 23rd day of April, A.D. 1918, to-wit;-

            The defendants were then asked if they had any legal cause to show why judgment should not be pronounced against them, and no sufficient cause being shown or appearing to the Court, and the Court having denied Motions for New Trial and Motions in arrest of Judgment; thereupon the Court rendered its judgment;

            THAT, WHEREAS, the said Bhagwan Singh – Bishan Singh Hindi - Chandra Kanta Chakravarty - Dhirendra Kumar Sarkar – Gobind Behari Lal - Godha Ram – Gopal Singh – Iman Din – Mahadeo Abaji Nandedkar – Munshi Ram – Naranjan Das – Nidham Singh – Santokh Singh –Taraknath Das – Joseph L. Bley – Franz Bopp – Robert Capelle – Edwin Deinat –Heinrich Elbo – Harry J. Hart – Louis T. Hengstler – J. Clyde Hizar – Henry Kaufmann – Charles Latendorff – Bernardo Manning – Walther Sauerbeck – Mortiz Stack Von Goltzheim and Eckart H. Von Schack having been duly convicted in this Court of the crime of conspiracy to violate Section 13 of the Criminal Code of the United States;

            IT IS THEREFORE ORDERED AND ADJUDGED that the said Franz Bopp and Eckhart H. Von Schack be imprisoned in the United States Penitentiary, at McNeil Island, State of Washington, for the period of two (2) years each, and that they pay a fine in the sum of Ten Thousand ($10.000.00) Dollars, each, said term of imprisonment.

Upon said defendants Franz Bopp and Eckhart H. Von Schack to commence upon the expiration of the term prescribed by the judgment heretofore entered in case No. 5885, United States of America vs. Franz Bopp, and Eckhart H. Von Schack;

            That Taraknath Das be imprisoned in the United States Penitentiary, at McNeil Island, State of Washington, for the period of twenty-two (22) months;

            That Santokh Singh be imprisoned in the United States Penitentiary, at McNeil Island, State of Washington, for the period of twenty-one (21) months;

            That Bhagwan Singh be imprisoned in the United States Penitentiary, at McNeil Island, State of Washington, for the period of eighteen months;

            That Robert Capelle be imprisoned in the United States Penitentiary, at McNeil Island, State of Washington, for the period of eighteen months (18) and that he pay a fine in the sum of Seven Thousand five hundred ($7500.00) Dollars;

            That Joseph L. Bley be imprisoned in the United States Penitentiary, at McNeil Island, State of Washington, for the period of fifteen (15) months and that he pay a fine in the sum of Five thousand ($5000.00) Dollars;

            That Gopal Singh be imprisoned in the United States Penitentiary, at McNeil Island, State of Washington, for the period of one (1) year and one (1) day;

That Charles Latendorff be imprisoned in the County Jail, Alameda County, State of California, for period of one (1) year;

            That Walther Sauerbeck be imprisoned in the County Jail, Alameda County, State of California, for period of twelve (12) months and that he pay a fine in the sum of Two thousand ($2000.00) dollars;

            That J. Clyde Hizar be imprisoned in the County Jail, Alameda County, State of California, for period of one (1) year and, that he pay a fine in the sum of Five thousand ($5000.00) Dollars;

That Godha Ram be imprisoned in the County Jail, Alameda County, State of California, for period of eleven (11) months;

That Gobind Behari Lal be imprisoned in the County Jail, Alameda County, State of California, for period of ten (10) months;

            That Edwin Deinat be imprisoned in the County Jail, Alameda County, State of California, for period of ten (10) months and that he pay a fine in the sum of fifteen hundred ($1500.00) Dollars;

            That Bishan Singh Hindi be imprisoned in the County Jail, Alameda County, State of California, for period of nine (9) months;

That Bernardo Manning be imprisoned in the County Jail, Alameda County, State of California, for period of nine (9) months and that he pay a fine in the sum of One thousand ($1000.00) Dollars;

That Harry J. Hart be imprisoned in the County Jail, Alameda County, State of California, for period of six (6) months and that he pay a fine in the sum of Five thousand ($5000.00) Dollars.

That Heinrich Elbo be imprisoned in the County Jail, Alameda County, State of California, for period of six (6) months and that he pay a fine in the sum of One thousand ($1000.00) Dollars;

That Moritz Stack Von Goltzheim be imprisoned in the County Jail, San Francisco County, State of California, for period of six (6) months and that he pay a fine in the sum of One thousand ($1000.00) Dollars;

That Naranjan Das be imprisoned in the County Jail, San Francisco County, State of California, for period of six (6) months;

That Iman Din be imprisoned in the County Jail, San Francisco County, State of California, for period of four (4) months;

            That Nidham Singh be imprisoned in the County Jail, San Francisco County, State of California, for period of four (4) months;

That Dhirendra Kumar Sarkar be imprisoned in the County Jail, San Francisco County, State of California, for period of four (4) months;

            That Mahadeo Abaji Nandekar be imprisoned in the County Jail, San Francisco County, State of California, for period of three (3) months;

            That Munshi Ram be imprisoned in the County Jail, San Francisco County, State of California, for period of sixty (60) days;

That Chandra Kanta be imprisoned in the County Jail, San Francisco County, State of California, for period of thirty (30) days and that he pay a fine in the sum of Five thousand ($5000.00) Dollars;

That Henry Kaufmann pay a fine in the sum of Five thousand Dollars ($5000.00) or be imprisoned in the County Jail, San Francisco County, State of California, for the period of six (6) months;

That Louis T. Hengstler pay a fine in the sum of Five thousand ($5000.00) Dollars;

Further Ordered that in default of the payment of fines imposed upon defendants Franz Bopp, Eckhart H. Von Stack, Robert Capelle, Joseph L. Bley, Walther Sauerbeck, J. Clyde Hizar, Edwin Deinat, Bernardo Manning, Harry J. Hart, Heinrich Elbo, Moritz Stack Von Goltzheim, Chandra Kanta Chakravarty, and Louis T. Hengstle, that they be imprisoned until said fines be paid or until the be otherwise discharged in due course of law.
